Most employers are subject to the wage and hour rules of the Fair Labor Standards Act (FLSA). Both state and federal law classify workers as either exempt or nonexempt, and your responsibilities vary depending on how each employee is classified.

Exempt employees aren't entitled to the benefits and protections of the FLSA. Nonexempt employees are protected by the FLSA.

When an employee is classified as nonexempt, it means that the employee is entitled to a minimum wage, overtime pay at the rate of time and one-half the regular rate for all hours worked in excess of 40 hours per week, as well as other protections under child labor and equal pay rules.

If you're subject to the FLSA, you'll also have to display a poster created by the federal government in your workplace, publicizing the federal minimum wage and overtime pay standards. Place the poster in a place where employees will see it as they come and go from work. If your worksite is large, you might also consider hanging these posters in a break room or on bulletin boards where employment-related information is posted.

The poster can be obtained from your local Wage and Hour Division office. To locate the Wage and Hour Division closest to you, check your phone directory (in the federal government listings). Under Employment Standards Administration, you should find a listing for the Wage and Hour Office.

Any person who is convicted of willfully violating any of the provisions of the FLSA, including failure to post, may be subject to a fine of not more than $10,000 or to imprisonment for not more than six months, or both.

Individual states may also have posting requirements that you'll have to comply with. In general, you have to post the state minimum wage and overtime laws, or summaries of these laws. In many cases, the state will, on request, furnish you with the posters that you need. The posting must be prominently displayed in a place accessible to employees.
